Yes, it's legal. Here's the fine print.
Weed is legal in Los Angeles for anyone 21 and up. A few rules decide whether your trip is easy or annoying.
California voters legalized adult-use cannabis in 2016. If you're 21 with a real ID, you can walk into a shop, reup, and carry it around. No card, no doctor, no residency.
What trips people up is everything after the purchase: how much you can hold, where you can light it, and what happens in the car. This is the short version, checked against state and city sources. Just the stuff a friend who lives here would tell you on the drive from the airport.
You need to be 21 with a valid ID
Every shop checks ID at the door. Under state rules a government-issued photo ID works, and that includes out-of-state driver's licenses, state ID cards, military IDs and passports, U.S. or foreign. So yes, tourists are fine.
Bring the actual card, not a photo of it. Staff decide whether your ID reasonably looks valid, so a cracked or peeling license can get you turned around. A foreign driver's license might not cut it on its own. If you're visiting from abroad, the passport is the safe bet.
Under 21 is a hard no unless you're 18 or older with a doctor's recommendation or a county medical ID card.
Do you need a medical card in California?
No. Adults 21 and over buy, carry and use cannabis without one. A medical recommendation or county card mostly matters if you're 18 to 20, or if you want the higher medical possession limits. For anything health related, ask your doctor.
How much weed can you buy and carry in California
The adult limit is 1 ounce of flower, which the law spells out as 28.5 grams, plus up to 8 grams of concentrated cannabis. Concentrates include stuff like carts, dabs and the THC in edibles.
That limit is about what you're holding at one time, not per shop. Two separate ounces in two separate bags is still two ounces. Going over is a crime, not a ticket, so don't stockpile on day one.
For a few days in town, an eighth or a quarter plus a cart covers most people with plenty left over.
Where you can legally smoke
Private property, with the owner's okay. That's a friend's place, your own place, or a rental where the host says it's cool. Owners and landlords can ban it, and many do.
Licensed consumption lounges are the other legal option. The City of LA doesn't allow them yet, so they're in West Hollywood and Hawthorne. We break them down on where to smoke, and you can scout the area on our WeHo page.
Not legal: sidewalks, beaches, parks, bars, restaurants, or anywhere tobacco smoking is banned. Same for within 1,000 feet of a school, day care or youth center while kids are around. Public use is technically a ticket. You'll still smell it all over Venice. Just be cool about it.
Hotels mostly treat rooms as smoke-free. Edibles keep things simple if your room is a no-smoke zone. And skip lighting up inside the shop where you bought it. That's not allowed outside of a licensed lounge.
Can you drive with weed in California?
You can drive with it in the car. You can't drive high, and you can't use it in the car, driver or passenger. Driving under the influence of cannabis is a DUI here, same as booze. Officers can pull you over and run a sobriety test.
Open container rules apply too. Keep it in the sealed package from the shop, or in the trunk. A half-smoked joint in the cup holder or loose flower rattling around the console is exactly what not to have.
The easy fix is letting somebody else drive. Rideshare is everywhere in LA, and it means nobody has to sit out the sesh.
Why the price at the register is higher than the menu
Sticker shock at checkout is normal. California charges a cannabis excise tax of 15 percent on retail sales. It jumped to 19 percent for a few months in 2025, then a new state law put it back at 15 percent starting October 1, 2025, and it's set to stay there until mid 2028.
Inside the City of LA, licensed shops also pay a city cannabis business tax of 10 percent of their adult-use sales. Neighboring cities set their own rates. Add it all up and the number on the receipt is noticeably bigger than the number on the menu board, so check whether a menu shows prices with tax or before tax.
Growing your own
Adults 21 and over can grow up to 6 plants per residence for personal use. Indoors, or in an outbuilding that's secured and fully enclosed. More than six is a crime.
Renters, check your lease, since landlords can say no. Cities can also add their own rules on top, especially for outdoor grows.
Every city sets its own rules
LA County is a patchwork of separate cities, and state law lets each one decide what cannabis businesses can do. The City of LA allows shops but bans consumption lounges for now. West Hollywood, a separate city, licenses them. Long Beach doesn't allow consumption at its businesses at all.
In practice that means the shop or lounge in one neighborhood might not exist two miles over. Check our neighborhood guides before you plan the day, then sort out food with where to eat high. Still have questions? Hit the FAQ.
